The Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996 (BOCW Act) regulates the employment and conditions of workers engaged in building, construction, alteration, repair, demolition, and maintenance works.
It is applicable to establishments employing 10 or more construction workers.
Every employer must register their establishment under the BOCW Act.
Application to be filed with State Labour Department (Form I).
Registration Certificate to be displayed at the site.
Employers must pay cess @ 1% to 2% of construction cost to the BOCW Welfare Board.
Paid in advance (based on estimated cost) or periodically (based on running bills).
Final cess payment after completion of project.
Provide safe drinking water, sanitation, first aid.
Provide canteen, crèche (if 50+ women workers), restrooms, temporary accommodation (if workers stay onsite).
Safety gear (helmets, gloves, belts, boots) for all workers.
Regular health check-ups for workers.
